Medical or Cosmetic? Understanding VAT in the Aesthetics Industry

The aesthetics industry continues to evolve at an incredible pace, with clinics investing in new technology, expanding their treatment menus and growing their teams. Alongside providing exceptional patient care, clinic owners are also navigating an increasingly complex financial and regulatory landscape.

One area that regularly causes confusion is VAT. A common misconception is that every treatment carried out by a medical professional is automatically exempt from VAT. In reality, the VAT treatment depends on the purpose of the treatment, not simply who performs it.

Where the primary purpose of a treatment is the protection, maintenance or restoration of a patient’s health, it may qualify for VAT exemption. Examples may include treatments provided for medical conditions such as hyperhidrosis (excessive sweating), certain
dermatological conditions or therapeutic anti-wrinkle treatments where there is a genuine medical purpose.

By contrast, treatments provided primarily to enhance a person’s appearance, such as cosmetic anti-wrinkle injections, dermal fillers or lip enhancement, will generally be subject to VAT. While this distinction may sound straightforward, the reality is often far more complex.

Many clinics provide a combination of both medical and cosmetic treatments, and understanding where each treatment sits for VAT purposes is essential. Introducing just one cosmetic treatment into an otherwise medically exempt clinic can have wider VAT implications than many business owners realise.

This is where the concept of partial exemption becomes important.
HMRC does not generally allow businesses making VAT-exempt supplies to recover all of the VAT they incur on their costs. Where a clinic provides both VAT-exempt medical treatments and VATable cosmetic treatments, it may become a partially exempt business, meaning a calculation may be required to determine how much VAT can be reclaimed.

In simple terms, some VAT incurred on business expenses may be recoverable in full, some may not be recoverable at all, and some may need to be apportioned between the clinic’s taxable and exempt activities.

This can affect everyday overheads such as equipment purchases, treatment couches, software subscriptions, rent, utilities, marketing costs, consumables and professional fees.

Without appropriate planning, clinic owners may recover less VAT than expected or face unexpected VAT liabilities later. The initial consultation also plays an important role. It is more than a clinical requirement; it helps establish the purpose of the treatment and provides valuable supporting evidence should the VAT treatment ever be questioned. Well-maintained consultation records, treatment notes and patient documentation can therefore be just as important from a tax perspective as they are from a clinical one.

VAT should also be considered when setting treatment prices. If a treatment is subject to VAT, failing to factor this into your pricing can have a significant impact on profitability. Equally, before introducing a new treatment or investing in new equipment, it is worth reviewing whether those changes could alter your clinic’s overall VAT position.
As your clinic grows and evolves, so too can its VAT obligations. Regular reviews can help ensure your VAT treatment continues to reflect the services you provide, allowing you to make informed business decisions with confidence.
